We serve unlawfully detained immigrants who are detained in Massachusetts, Maine, New Hampshire, Rhode Island, or Vermont.

The individual must have (or be able to immediately obtain) immigration counsel. Habeas assistance is provided in partnership with the immigration attorney, who must be available to assist in the preparation of the habeas filing and litigation of the case.

What is NOT within the scope of this Project:

• Cases where someone has been transferred to a jurisdiction outside of New England. See “Resources” for projects outside New England.

• Cases where the immigration attorney is unable to provide ongoing support in the habeas process. The habeas volunteer has committed only to the emergency filing. Any continued involvement beyond that point will be discussed and mutually agreed upon by the immigration attorney and the habeas volunteer.

• General questions about habeas petitions.
